Terms and Conditions

1. COMPETITION SCOPE

These terms and conditions apply to all "Bend a SmartCard Competition" challenges, including but not limited to:

  • Competitions involving purchased SmartCards
  • "On the street challenges" conducted by our team members
  • Any and all challenges initiated by our salespeople or representatives
  • All related promotional activities and demonstrations

2. DEFINITION OF "BEND"

For the purposes of this competition, a successful "bend" is defined as:

  • A physical deformation of the SmartCard creating an angle of 90 degrees or more
  • The bend must be clearly visible and measurable
  • The card must maintain its structural integrity (not break or snap)

3. BEND MEASUREMENT AND DISPUTES

  • Successful bends will be measured using a protractor to verify the 90-degree minimum requirement
  • SmartCard's measurement is final and binding
  • All angle disputes will be resolved solely at SmartCard's discretion using protractor verification

Participants may ONLY use the following method:

  • Hand bending only - using fingers, palms, and manual grip strength
  • No tools, devices, or external assistance of any kind

5. PROHIBITED METHODS

The following methods are strictly prohibited and will result in immediate disqualification:

  • Prying with any object or tool
  • Kicking, stepping on, or using feet
  • Placing in vices or vice-like mechanisms (including but not limited to door hinges, car doors, drawer slides)
  • Placing under tires or using vehicles in any capacity
  • Using power tools of any kind (drills, sanders, grinders, etc.)
  • Using hand tools (pliers, wrenches, screwdrivers, etc.)
  • Using heat sources (lighters, heating elements, etc.)
  • Using chemical treatments or solvents
  • Any method involving external pressure or leverage beyond manual hand strength

6. VERIFICATION REQUIREMENT AND CEO AVAILABILITY

Any participant who successfully completes the challenge through any means (purchased card or on-the-street challenge) must, if requested by our company, demonstrate their ability by bending a brand new SmartCard provided by us. This verification:

  • Must be performed by hand only, in the presence of our CEO or designated representative
  • Must be completed within a reasonable timeframe when requested
  • Is required to ensure fair play and verify legitimate completion
  • Failure to complete CEO verification when requested will nullify the original achievement and forfeit any prize
  • If the participant fails to bend the CEO verification card successfully, they do not win, as we cannot verify the legitimacy of their original attempt
  • If CEO is unavailable for extended periods, a designated company representative may conduct verification
  • Verification scheduling will accommodate both company and participant availability within reasonable limits

7. FRIVOLOUS LEGAL CLAIMS

Participants agree that:

  • Any legal claims against SmartCard must be based on legitimate grievances
  • Participants will be responsible for SmartCard's attorney fees and costs if they pursue frivolous, baseless, or bad-faith legal claims
  • SmartCard reserves the right to pursue counter-claims for malicious prosecution or abuse of process

8. GENERAL RULES

  • All participants must be 18 years or older, or have parental consent if under 18
  • Participants compete at their own risk
  • Our company reserves the right to verify any claimed success
  • These terms apply universally to all competition formats and locations
  • Rules are subject to change at our company's discretion
  • Disputes will be resolved at the sole discretion of company management

9. PRIZE STRUCTURE

  • Standard reward: $100 USD for successful completion of any competition
  • Special/promotional contests may offer different rewards as announced on the official SmartCard.Sale website
  • Payment is NOT immediate - winners will receive payment from the CEO at a scheduled verification meeting
  • Each individual is limited to one (1) win regardless of multiple successful attempts
  • Multiple winners are permitted for the competition overall

8. COMPETITION DURATION

This competition will remain active until officially canceled by SmartCard management.

9. GEOGRAPHIC RESTRICTIONS

This competition is limited to participants within the United States only.

10. INTELLECTUAL PROPERTY AND MEDIA RIGHTS

By entering this competition (whether winning or losing), participants grant SmartCard unlimited rights to:

  • Use any videos, photos, or media captured during the competition
  • All competition-related content becomes SmartCard intellectual property
  • Media may be used for promotional, marketing, or any other business purposes

11. PRIVACY POLICY

Standard privacy policies apply to all participant data collection and usage.

12. DISQUALIFICATION AND ANTI-FRAUD MEASURES

  • Automatic disqualification for breaking any competition rules
  • Participants attempting to cheat, scam, or blackmail SmartCard or team members will be:
    • Permanently disqualified from all current and future SmartCard competitions
    • Subject to potential legal action if necessary
  • All disqualification decisions are final

14. FORCE MAJEURE

SmartCard is not liable for competition delays or cancellations due to events beyond our reasonable control.

15. GOVERNING LAW AND JURISDICTION

These terms are governed by United States federal and applicable state laws.

16. EMPLOYEE AND FAMILY ELIGIBILITY

SmartCard employees and their family members are eligible to participate, as this is a merit-based competition requiring strength and skill. All employees/family members must complete the same CEO verification process.

17. ENTRY LIMITATIONS

Each participant is limited to one (1) entry per 30-second period.

18. TAMPERING PREVENTION

The requirement to bend a second brand new card in-person before the CEO ensures no tampering or pre-manipulation has occurred.

19. WITNESS AND EVIDENCE REQUIREMENTS

  • Video evidence is mandatory for all attempts
  • All entries must include video documentation of the bending attempt
  • CEO verification serves as official witness for final confirmation

20. VIDEO DOCUMENTATION REQUIREMENT

A video recording of the bending attempt is required for all submissions, whether successful or unsuccessful.

21. CARD REPLACEMENT POLICY

  • Any cards that are fairly bent (including the secondary CEO verification card) will be fully replaced free of charge
  • All unbent cards remain with the owner
  • No refunds available for unbent cards to prevent abuse of purchase-and-return schemes

22. COMPETITION AND PRIZE MODIFICATION RIGHTS

SmartCard reserves the right to:

  • Cancel or amend the competition or rules at any time
  • Modify prize amounts, structure, or payment methods
  • Change verification procedures as deemed necessary

All modifications will be announced via:

  • Official SmartCard.Sale website
  • Company social media channels

23. AGE REQUIREMENTS

Participants of any age may compete in this challenge.

24. MEDICAL DISCLAIMERS

Participants with pre-existing medical conditions compete at their own risk. Consult healthcare providers before participating if you have concerns about physical strain.

25. FINAL VERIFICATION PROCESS

The CEO will conduct final verification by providing a brand new card for in-person bending demonstration to ensure fair play.

26. WINNER DETERMINATION

  • Multiple winners are possible
  • Each winner is limited to one (1) victory
  • Winners are determined immediately upon successful completion and CEO verification

27. PAYMENT TIMELINE

Winner verification and payment scheduling will be arranged by the CEO at a mutually convenient time to accommodate team schedules.

28. LIABILITY

Participants acknowledge that they engage in this competition voluntarily and assume all risks associated with the activity. SmartCard is not liable for any injuries or damages resulting from participation.

By participating in any Bend a SmartCard Competition, participants acknowledge they have read, understood, and agree to abide by these terms and conditions.
